These general terms and conditions of sale are agreed between the company ELLIPSE FITNESS with tax designation MCVT SPORT&FITNESS LDA, with registered office at Rua Visconde Gemunde, nº671 4760-392, V.N. Famalicão with tax identification number 509 994 822 and contact +351 252 080 647, hereinafter referred to as “ELLIPSE FITNESS®“ and people who wish to make purchases through the website www.ellipse-nutrition.com hereinafter referred to as "User".

- The purpose of these general terms and conditions of use is to define the conditions of access to and navigation on the website by the customer who intends to make purchases in the online store. The general conditions of sale aim to regulate the operational terms of commercial transactions carried out between ELLIPSE FITNESS and the Customer.
- The Privacy Policy aims to identify privacy protection measures with regard to the processing of personal data and the free movement of data of natural persons, including personalized management tools for personal data provided by customers.

- In general terms, personal data is collected in three situations directly arising from ELLIPSE FITNESS activity.
- User registration: creation of the ELLIPSE FITNESS customer account and purposes of data processing:
- For the purpose of creating a customer account, a customer area is available in which you must enter the data necessary to identify you as a customer. Making the first purchase will depend on the provision of additional personal data, essential for processing the order and its delivery.
- The mandatory fields in the forms available for those registration phases are marked with an asterisk (*).
- ELLIPSE FITNESS is committed to protecting customer data and it will never be made available to third parties without the owner's knowledge or consent, as legally required.
- When processing the customer's order, it is possible that certain personal data (such as address and postal code) may be disclosed to third parties for the sole purpose of preventing and detecting fraud and always following an inquiry for this purpose by the customer. of the competent authorities. Furthermore, when making a purchase on the website, data relating to the delivery address and payment details will also be requested, in order to ensure the greatest possible efficiency and compliance with delivery deadlines.
- The data provided will be kept for the strictly necessary period of time, which normally corresponds to the period of existence of the customer account. For this reason, the moment the customer cancels the customer account, personal data will be permanently deleted, with the exception of data necessary to comply with legal obligations, which will be archived in a database specifically designed for this purpose and for as long as possible. necessary. - Payment deadline and methods: After completing the order process in the customer account, the customer has a period of time (24 hours) to proceed with the payment. After this period, the order will be cancelled.

- ELLIPSE FITNESS offers the following payment methods for purchases made in the online store:
- Credit Card: The customer can pay by credit card and enjoy the advantages of liquidity and payment terms that their bank offers. All transactions on our website are secure.
- MB WAY. You can choose to make payments using your cell phone, which makes the process faster, more convenient and safer.
- Multibanco: Payments by Multibanco can be made through the Multibanco Caixa Network or through your Homebanking. When completing your order, an ATM reference will be generated. The customer will receive this reference in the order confirmation email. To make a payment at an ATM, the customer must select the "Payment for Services/Purchases" option and enter the corresponding entity, reference and value.
- Bank transfer, or others presented for this purpose. It will always be subject to the user's choice.
- If, after 24 hours, the customer has not completed the transfer, the order will be cancelled.

- Notice: Payments are always made in Euros, even when prices are shown in other currencies. Some banking entities may charge exchange fees. ELLIPSE FITNESS is completely unaware of this fact and therefore assumes no responsibility for it.

- Depending on the country in question, ELLIPSE FITNESS may provide other payment methods, the detailed description of which will be provided, upon request, by Customer Service:

- Warning: Given the current economic situation and recent international constraints, not all payment methods may be available at the same time. For this reason, the identification and conditions of use of each payment method available at a given time are published in the last step of the order process, immediately prior to order confirmation. Such conditions will, as such, only be valid for the respective purchase, considering, for that purpose and whenever applicable, its validity period.

- The ELLIPSE FITNESS website is available for purchases in the online store only for products that have a price.
- All products without price are subject to consultation for quotation by ELLIPSE FITNESS.
- To purchase from the online store, select the desired product and add it to the shopping cart.
- Follow the checkout instructions to fill in your order details.
- Select the desired payment method available in the store at the time.
- Confirm order details to avoid errors.
- Select the shipping/transport method available on the page.
- ELLIPSE FITNESS products can be picked up in store, eliminating shipping costs.
- Complete the payment within a maximum period of 24 hours.
- Billing details must be filled in at the time of ordering.
- If you want delivery to an address different from the billing details, you must mention it when placing the order in the field indicated.
  - The product will be sent to the address provided by the customer within a maximum period of 72 hours.
- Data verification: The data provided at the time of ordering is checked to ensure that the order is processed securely to the correct address. The customer is responsible for providing correct and complete information.
If the data is incorrect or incomplete, which results in the order not being delivered due to lack of data, ELLIPSE FITNESS does not assume any cost or responsibility, resulting in a new delivery request and respective cost.

* ELLIPSE FITNESS reserves the right not to accept the order or cancel the purchase at any time and for any reason. The customer will be refunded in full.

- All ELLIPSE FITNESS equipment is subject to stock availability.
- Delivery times for small materials (online store) vary between 3 working days for mainland Portugal, and up to 7 working days for all of Europe.
- For large products, these are subject to a prior quote, calculation of delivery and assembly costs.
- The deadline varies between immediate delivery and 90 days, depending on STOCK availability and the technical team availability scheduling process.
- The deadline can be extended up to 120 days, this being for personalized orders.
- Delivery time is subject to scheduling up to 8 days before delivery.

* All personalized orders do not entitle the customer to cancellation or refund.
* Please note that normal delivery times may vary depending on the product and the origin/destination relationship, weather incidents, customs services, or operational delays.

- Order cancellation before shipping for small materials (online store) can only be done up to 24 hours after ordering.
- Cancellation after the order is subject to costs, if the equipment has already been shipped, the cost of shipping and collecting the equipment will be charged to the customer.
- The cancellation of large orders is subject to the aforementioned guidelines, and the termination of the contract by mutual agreement between the parties.
- ELLIPSE FITNESS reserves the right to cancel the order at any time before shipping. If this happens, the order value will be refunded to the customer within 15 days.
- Return of defective products: The customer has the right to a return if he finds that the products supplied have defects or other non-conformities in relation to the items ordered.
- The return of incomplete, damaged or scratched products, as well as products without the original packaging and/or label, or products with evidence of having been used, will not be accepted.
- The defect must be reported within a maximum period of 48 hours after receipt of the product to the email sales@ellipse-fitness.com.
- The customer must attach photographs/videos to the email that prove the non-conformity of the packaging/product.
- The return can be made within 15 days after notification of the defect against presentation of the original invoice and the product must maintain all original elements.
- The seller will analyze the returned product and inform the user of the right to a refund (if applicable), or exchange for the same or another product depending on the customer's option (taking into account that a possible exchange for an item of value higher, the customer will have to pay the difference).
- As a rule, ELLIPSE FITNESS issues refunds within 15 working days from the date of confirmation via email of the right to refund.
- For returns and exchanges, the customer must request it via email at info@ellipse-fitness.com.
- If the defect or non-conformity is confirmed as reasons justifying the return, the entire amount paid will be refunded. The refund of the amount paid will be made by bank transfer. These provisions do not affect your statutory rights.
- Each of the items to be returned must, therefore, be shipped under the conditions listed above, and the freight forwarder's label must be affixed to the original transport box, or another alternative that guarantees the good conservation of the product, with the label being destroyed after confirmation of the conservation status of the returned product(s).
- If any of the conditions previously stated are not met, the customer will lose the right to a refund.

- They have not been washed or used (unless the product contains information to the contrary). The customer has the right to try the equipment and accessories, but may not use them.
- Maintain the original characteristics and the packaging is not damaged (packages opened carefully will not be considered damaged).
- Are complete (e.g. both items in a pair must be returned).
- They have not been tampered with and maintain the identification label, if the product has this label.
- All items that are manufactured by customization are not subject to return.

- In addition to the conditions specifically set out in the previous paragraph, the customer must also take into account whether the product they wish to return was purchased as part of a promotional campaign and whether, for that reason, they benefited from any product offering. If this is the case, the customer must return not only the product in question, but also the offer given to them with their purchase. Both products must comply with the previously mentioned guidelines.
- The return of an offered product must be made by the person who offered/purchased it, presenting the original invoice.
- If the defect or non-conformity is confirmed as reasons justifying the return, the entire amount paid will be refunded. The refund will be made to the debit or credit card used to make the purchase or by bank transfer.
The right to return only occurs if the products:
- They have not been washed or used (unless the product contains information to the contrary). The customer has the right to try the equipment and accessories, but may not use them.
- Maintain the original characteristics and the packaging is not damaged.
- Are complete (e.g. both items in a pair must be returned).
- They have not been tampered with and maintain the identification label, if the product has this label.
- All items that are manufactured by customization are not subject to return.
- The customer is responsible for the return and shipping costs of the returned merchandise.
- Pack return: This can be done in its entirety, or if the customer wishes to return only certain products from this pack, they must return the products that make up the pack under the conditions previously mentioned. The refund of the corresponding amount will be made in the manner previously mentioned.

- To exchange an item for another item, you must request the exchange via email at sales@ellipse-fitness.com.
- An item can only be exchanged for another of equal or greater value and products can only be exchanged once. If you are not satisfied after placing an exchange order, you can only return your order and place a new order.
- The customer is responsible for the return and shipping costs of the returned merchandise. The return must be accompanied by the original invoice.
The right to exchange only occurs within the previously mentioned parameters.

- We deliver orders from Monday to Saturday. Shipments are not made on certain holidays (you can obtain confirmation by sending an email to sales@ellipse-fitness.com).
- We guarantee the delivery of an order to the requested address, whether it is a home or a place of work and deliveries are not made to PO Boxes.
- Preparation and dispatch of the order from the warehouse may take up to 2 working days (5 working days for large volume orders) after payment confirmation.
- After dispatch, delivery time varies depending on location and carrier.

Shipping costs are automatically calculated by our system and depend on the following factors:
- Actual weight of the order;
- Carrier tariffs, which are periodically updated;
- Customer shipping address.

- ELLIPSE FITNESS works in partnership with carriers so that the following shipping times can be ensured. However, these may vary for reasons beyond ELLIPSE FITNESS's control.
- Mainland Portugal: 1/2 working days (5 working days for large volume orders)
- Islands (Azores/ Madeira): Between 5 and 8 working days.
- Spain: 2/3 working days (5/7 working days for large volume orders).
- For other European countries in small volume orders, delivery is expected within 3/5 working days.
- For other European countries in large volume orders, shipments are weekly, dispatched on Fridays, with delivery within 7/10 working days.
- For other countries outside the European continent for small volume orders, delivery is expected within 15 working days.
- For other countries outside the European continent for large volume orders, the delivery forecast will be subject to prior consultation.

- Refusal of receipt or non-delivery, for reasons not attributable to ELLIPSE FITNESS or the carrier, will result in the loss of the right to a refund of the shipping costs of the order.
